Brian S. Hormozi
Associate

Brian Hormozi is an associate in Schuyler, Roche & Crisham’s Business Litigation practice group, focusing on general commercial and employment litigation. Brian’s areas of practice include trade secrets, unfair competition and restrictive covenant enforcement. His experience extends to all phases of litigation in state and federal court, and his responsibilities include representing clients in arbitration before the National Association of Securities Dealers Dispute Resolution and the New York Stock Exchange—the two largest fora devoted to arbitrating financial and other types of disputes within the securities industry.

As a law student, Brian served as an extern for Federal District Court Judge Elaine Bucklo of the Northern District of Illinois.

Areas of Practice
Concentrating in business and employment litigation, Brian has helped counsel representatives from a major Wall Street broker-dealer, in addition to small and large companies, real estate management startups, investors and individuals. Recently he has:

  • served as second chair in a jury trial in the Circuit Court of Cook County
  • assisted on a number of claims in state and federal court and in arbitration to obtain injunctive relief against employees who violated the terms of their restrictive covenants and misappropriated trade secrets from their former employer
  • aided senior members of Schuyler, Roche & Crisham’s litigation team on behalf of a Wall Street broker-dealer in asserting claims of employee raiding, tortious interference and unfair competition against rival firms following a major corporate acquisition
  • prosecuted debt collection actions seeking repayment of employee forgivable loans
  • researched and drafted pleadings, briefs and memoranda on legal issues arising out of trade secret misappropriation, breach of employee duty of loyalty, unfair competition, tortious interference and restrictive covenant enforcement
  • researched and drafted summary judgment motions and supporting documents in state and federal court addressing claims of defamation, employment discrimination, liability under the federal False Claims Act and the application of discounts to minority shareholder interests in a dissenter’s rights action
  • aided in defending a Wall Street broker-dealer and a financial advisor in NASD arbitrations against customer claims of unsuitable investments, breach of fiduciary duty, unauthorized trading and churning
  • formed several limited liability companies in Illinois, including a number of series limited liability companies for small businesses engaged in real estate investment and management.

Achievements
Brian has been fortunate to help senior litigators on a number of successful cases for Schuyler, Roche & Crisham’s clients, including having:

  • assisted Michael B. Roche, who heads our Business Litigation practice group, in prosecuting claims in arbitration that ultimately resulted in an award exceeding $300,000 for a disabled claimant who had asserted negligence and breaches of fiduciary duty against a financial institution, claims that arose from the misappropriation of trust funds by invalidly appointed co-trustees
  • assisted Michael B. Roche and another senior litigator in prosecuting claims that included misappropriation of trade secrets, breach of fiduciary duty and unfair competition—ultimately achieving a significant monetary damage award for a regional retail brokerage outfit
  • extensively researched and drafted briefs concerning the inapplicability of lack-of-control and lack-of-marketability discounts when assessing the fair value of a dissenting minority shareholder’s interest in a closely held corporation—activity that ultimately contributed to a significant victory in a case of first impression in the Wyoming Supreme Court, which disallowed these discounts in dissenters’ rights cases.
