McGovern v. AMEC Construction: Tom Crisham, Dan Stanner and Esther Choi successfully petitioned the Circuit Court of Cook County for summary judgment in a case in which a concrete carpenter fell five stories down an elevator shaft. Crisham & Kubes represented the general contractor, the owner's representative and the developer. Judge Marcia Maras agreed with Crisham & Kubes' argument that the plaintiff could not establish a liability case under either Section 414 or Section 343 of the Restatement (Second) of Torts. In particular, the court found that there was no evidence that the general contractor, the owner's representative or the developer directed the operative details of the plaintiff's work. The court also found that the plaintiff failed to present evidence that the defendants had any notice of a dangerous condition existing on the job site. |
